Terms of service

1. Scope of Application
These General Terms and Conditions (hereinafter "GTC") apply to all orders placed on the website jessamigaillard.com, operated by Jessami Gaillard (hereinafter "the Seller"), by any individual or legal entity (hereinafter "the Client").
By placing an order on the website, the Client fully and unconditionally accepts these GTC.

2. Products and Creations
The Seller offers for sale:
  • Prints of original artworks (reproductions).
  • Customized clothing and accessories, hand-painted or made-to-order.
Each customized piece is unique or produced in very limited series. The photographs on the website are as accurate as possible but cannot guarantee a perfect match with the final product (particularly regarding color nuances of the paint or textiles).

3. Pricing and Payment
  • Prices: All prices are stated in Swiss Francs (CHF), excluding shipping costs.
  • VAT: As an independent artist not registered for VAT (turnover below CHF 100,000), VAT is not applicable (VAT exempt, art. 10 MWSTG). The displayed price is the final price.
  • Payment: Payment must be made in full at the time of ordering via the payment methods provided on the website (e.g., [Twint, Credit Cards, Stripe, PayPal]). Orders will be processed upon receipt of payment. 
4. Intellectual Property
The purchase of a print or customized garment does not transfer any intellectual property or copyright to the Client.
The artist, Jessami Gaillard, retains exclusive ownership of all visuals, paintings, designs, and creations displayed on the products and the website. Any reproduction, scanning, modification, or commercial use of the artworks without prior written consent from the artist is strictly prohibited (Swiss Federal Act on Copyright - URG).


5. Warranty for Defect (Claims)
The Client is required to inspect the goods immediately upon delivery. In the event of a defect (e.g., wrong product, damaged garment prior to shipping), the Client must contact the Seller by email within 10 days of delivery, providing supporting photographs.
If the defect is verified, the Seller will either replace the product or issue a refund.

6. Data Protection
The Client's personal data (name, address, email) are collected solely for order processing and shipping purposes. They are treated with the utmost confidentiality in compliance with the Swiss Federal Act on Data Protection (FADP/nDPA) and are never sold or transmitted to unauthorized third parties.

7. Applicable Law and Jurisdiction
These GTC are exclusively governed by Swiss law.
In the event of a dispute, the exclusive place of jurisdiction shall be in Valais, Switzerland.
